Complaint Procedure under the Americans with Disabilities Act and Section 504 of the Rehabilitation Act

Report ADA Complaints

If you believe that the City of Sunnyvale has violated Title II of the Americans with Disabilities Act (ADA) by denying access to City programs, services, or activities based on a disability, you or an authorized representative may submit a formal complaint through an electronic form (available below) pursuant to this ADA Complaint Procedure.

Upon request, copies of this ADA complaint procedure and complaint form are provided by the City pursuant to Title II of the ADA.

The ADA does not require the City take any action that would fundamentally alter the nature of its programs or services or impose an undue financial or administrative burden upon the City.

Use of this complaint procedure neither precludes nor is it a prerequisite to the pursuit of other remedies.

NOTE: The ADA Complaint Procedure is for reporting allegations regarding the City's programs, services, and activities as covered under Title II of the ADA. The ADA Complaint Procedure is not used for reporting complaints against private landlords, private businesses, other government agencies, or other non-City entities.

ADA Complaint Procedure

  • Submit complaint in timely manner 

    The complaint form (available below) alleging a violation of the ADA should be submitted by you or your authorized representative as soon as possible, but no later than 60 calendar days after the alleged violation.

  • Prepare your complaint

    The complaint form should contain as much information as possible concerning the alleged violation, and include the following information:

    • Description of the alleged discriminating activity, policy, program or service
    • Date, time and location details
    • Names of any alleged offenders
    • Names of any witnesses
    • Desired outcome

    Upon request, reasonable accommodations will be provided in completing this form, or the form will be provided in alternative formats. Contact the ADA Coordinator for accommodation.

  • Submit your complaint

  • Investigation and decision

    The City will review and investigate the complaint. Within 15 calendar days of receipt of your complaint, the ADA Coordinator will contact you to acknowledge your complaint. A City representative may also contact you to discuss the complaint and possible resolution.  Within 30 calendar days of the complaint, you will be notified  in writing by the ADA Coordinator stating the results and determination as to the action to be taken, if any. Upon request, the City will make every reasonable effort to communicate the decision in an alternative method, which you can understand.

  • Appeal process

    If the complaint cannot be resolved to your satisfaction, you or your authorized representative may request a hearing before the City Manager or their designee. The City Manager or their designee must receive your appeal within 15 calendar days after receiving the City’s decision. Your request must state why you are appealing the determination. Include any proposed remedies as well as what you are seeking. The City Manager or their designee will contact you to determine the time and place of the hearing.

    Within 15 calendar days of the hearing, the City Manager or their designee will inform you of the decision in writing, or in an accessible alternate format. The decision of the City Manager will be the City’s final decision on the complaint.

Additional Information

The City will not retaliate against you for filing a complaint. Any form of retaliation related to the filing of this complaint is prohibited and should be reported immediately to the ADA Coordinator.

You may pursue other remedies, such as the filing of a complaint with the Department of Justice, the Equal Employment Opportunity Commission, or any other governmental agency. It will not impair your right to a prompt and fair resolution of your complaint.

Be advised that some of the information you supply on this complaint form may be subject to public disclosure under the California Public Records Act. The City will make every reasonable effort to ensure that confidentiality is maintained throughout the complaint, investigation and corrective action process, to the extent consistent with the law.

All documented complaints received by the ADA Coordinator, appeals to the City Manager and responses from these offices will be retained by the City of Sunnyvale for at least three years.
