MINUTES

A regular meeting of the Sunnyvale Planning Commission was held on September 27, 1999, at 8:00 p.m. in the Council Chambers, City Hall, 456 West Olive Avenue, Sunnyvale, with Chair Howe presiding.

Members Present: Chair Howe; Comms. Brown, Flanagin, Lee, Piazza and Satterlee.

Members Absent: Vice Chair Hornberger (Excused)

Staff Present: Trudi Ryan Planning Officer; Jerry Coleman, Acting Assistant City Attorney; Fred Bell, Principal Planner; Diana Peattie, Planner; Diana Perkins, Planner; and Alice Gamboa, Recording Secretary

PUBLIC HEARING:

Approval of Minutes

Comm. Satterlee made a motion to approve the minutes of September 13, 1999 with modifications. Comm. Flanagin seconded.

Motion carried unanimously 6-0. Vice Chair Hornberger absent.

Report on Council Meeting

Trudi Ryan, Planning Officer, reported that on September 14,1999, City Council considered the appeal on the teen program at Le Boulanger. The City Council upheld the Planning Commission's decision, denied the appeal and approved the Design Permit.

Planning Officer’s Report

Trudi Ryan, Planning Officer, reported that Agenda Item #1 was withdrawn after hearing testimonies from the residents of the neighborhood. She stated that staff wrote a letter to the interested parties about the withdrawal. There was no action needed of the Planning Commission.

  1. 1999-0809 - Budget Publications, Inc. (Devcon Construction): Application for a Use Permit to allow an industrial building at 39% Floor Area Ratio where 35% is allowed without a Use Permit. The property is located at 370 San Aleso Avenue in an M-S (Industrial and Service) Zoning District. (APN: 204-01-005) (Negative Declaration) SD (Continued from August 9, 1999)

The applicant withdrew the application.

  1. Laurie & Alex Trujillo (Thomas Whitford): Applications for related proposals for a property located at 323 Beemer Avenue in an R-2 (Low-Medium Density Residential) Zoning District. (APN: 204-51-024) DRP (Also to City Council on October 19, 1999)

1999-0736 - Rezone from R-2 (Low-Medium Density Residential) Zoning District to R-2/PD (Low-Medium Density Residential/Planned Development).

Comm. Satterlee made a motion on Item #1999-0736 to approve the Rezone in accordance with staff recommendation. Comm. Lee seconded. Motion carried unanimously 6-0. Vice Chair Hornberger absent.

1999-0737 - Special Development Permit to allow construction of a new single-family residence on a flag lot and an addition of a two-car detached garage to an existing residence on the front lot.

Comm. Satterlee made a motion on Item 1999-0737 Special Development Permit to continue to October 11, 1999 public hearing to address the setbacks; gabling and the shading concerns. Comm. Flanagin seconded. Motion carried unanimously 6-0. Vice Chair Hornberger absent.

1999-0738 - Parcel Map to allow subdivision of one parcel into two lots.

Comm. Satterlee made a motion on Item #1999-0738 to continue the Parcel Map Permit to October 11, 1999 in conjunction with the Special Development continuance. Comm. Flanagin seconded. Motion carried unanimously 6-0. Vice Chair Hornberger absent.

  1. Hanh Nguyen: Applications for related proposals for a property located at 1161 Waverly Street in an R-2 (Low-Medium Density Residential) Zoning District. (APN: 165-15-034) (Negative Declaration) DP (Also to City Council on October 19, 1999)

1999-0934 - Rezone from R-2 (Low-Medium Density Residential) Zoning District to R-2/PD (Low-Medium Density Residential/Planned Development).

Comm. Lee made a motion on Item #1999-0934 to approve the Rezone from R-2 to R-2/PD in accordance with staff recommendation. Comm. Flanagin seconded. Motion carried unanimously 6-0. Vice Chair Hornberger absent.

1999-0935 - Special Development Permit to allow construction of three townhome units.

Comm. Lee made a motion on Item #1999-0935 to approve the Special Development Pemit in accordance with staff recommendation subject to Conditions of Approval. Comm. Flanagin seconded. Motion carried 5-1. Comm. Satterlee dissented and Vice Chair Hornberger absent.

  1. 1999-0009 - City of Sunnyvale: A review of alternative methods to establish fair market value of residential development projects for the purpose of calculating Park-In-Lieu Fees. FB (Also to City Council Public Hearing on October 19, 1999.)

Comm. Brown made a motion on Item #1999-0009 to recommend to City Council to adopt Alternative #1 in accordance with staff recommendation. Comm. Flanagin seconded. Motion carried 5-1. Comm. Satterlee dissented and Vice Chair Hornberger absent.

Oral Communications

Comm. Piazza reported that it was her last Planning Commission Meeting as she will no longer be a resident of the City of Sunnyvale. She thanked the professionalism and support of staff and thanked her fellow commissioners.

Her fellow commissioners thanked Comm. Piazza for her services and support to the City of Sunnyvale. The City of Sunnyvale is in a better shape with her services; her architectural guidance was much appreciated; and the knowledge she shared with her fellow commissioners.

Staff wished Comm. Piazza well and thanked her with her services. Her many years of service provided continuity to this important governing body.
